Terms of Service

These Terms of Service ("Terms") govern your use of the Curate by Slay mobile application ("the App") operated by Slay Technologies Limited ("we", "us", "our").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By creating an account, you confirm that you meet this minimum age requirement.

Users between 18 and the age of majority in their jurisdiction should obtain parental consent before using the App.

2. Your Account

  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at support@curatebyslay.com if you suspect unauthorized access.
  • One person, one account. Creating multiple accounts to abuse promotions or evade restrictions is prohibited.

3. Acceptable Use

You agree NOT to:

  • Upload illegal, offensive, or harmful content.
  • Attempt to reverse-engineer, decompile, or hack the App.
  • Use the App for any unlawful purpose.
  • Upload images you do not have the right to use.
  • Generate content that infringes on others' intellectual property.
  • Attempt to bypass payment, credit limits, or rate limiting.
  • Use automated tools (bots, scrapers) to access the App without our written permission.

Violation of this section may result in account suspension or termination, with no refund of unused credits.

4. Credits & Payments

  • Credits are purchased through Paystack and are used to generate outfits.
  • Credits do not expire as long as your account is active.
  • Credits are non-refundable except as required by Nigerian consumer law.
  • Pricing is shown in Nigerian Naira (NGN) and is inclusive of applicable taxes.
  • We may adjust credit pack pricing at any time. Existing purchased credits are honored at their original value.

Refunds

We will refund credits in the following cases:

  • A generation fails due to a technical error on our side (automatic refund).
  • A duplicate charge is confirmed (refund within 7 business days).
  • A payment is made in error and reported within 24 hours (case-by-case review).

5. Generated Content

  • You own the outfits you generate using your fabric images.
  • You grant us a limited, non-exclusive license to display generated outfits to you within the App.
  • We may use anonymized, aggregated patterns (e.g., "users prefer modern traditional styles") to improve the service, but we do not use your specific outfits to train AI models.
  • Generated outfits are created by an AI model and are provided "as is" — we do not guarantee they will be tailored exactly to your expectations.
  • All generated outfits are produced by artificial intelligence and carry a visible "Curate by Slay" watermark identifying them as AI-generated. You agree not to remove, obscure, or alter this watermark.
  • If you believe a generated or uploaded image is inappropriate, offensive, or objectionable, you can report it using the in-app Report feature. We review all reports and may remove content or suspend accounts that violate these Terms.

6. Intellectual Property

  • The App, its design, branding, and underlying technology are owned by Slay Technologies Limited.
  • "Curate by Slay" and the Curate logo are trademarks of Slay Technologies Limited.
  • You may not copy, modify, or distribute any part of the App without our written permission.

7. Service Availability

  • We strive for high availability but do not guarantee uninterrupted service.
  • Scheduled maintenance will be announced when possible.
  • Outages caused by third-party providers (Paystack, Google, Cloudflare) are outside our direct control, though we monitor and mitigate where we can.

8. Termination

By You

You may delete your account at any time via the in-app Settings. Account deletion is final — see our Privacy Policy for retention details.

By Us

We may suspend or terminate your account if:

  • You violate these Terms.
  • We detect fraudulent payment activity.
  • Required by law or court order.

In case of termination for cause, unused credits are forfeited.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by Nigerian law:

  • Our total liability for any claim arising from your use of the App is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, consequential, or punitive damages.

This limitation does NOT apply to:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded under Nigerian law.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be subject to the exclusive jurisdiction of the courts of Abuja, FCT, Nigeria.

12. Changes to These Terms

We may update these Terms from time to time. When we do:

  • The version number and effective date at the top will change.
  • Material changes will be communicated via in-app notice or email.
  • Continued use of the App after changes constitutes acceptance.
